PLEASE READ THESE TERMS CAREFULLY BEFORE PLACING AN ORDER.
By placing an order on HOARiskInsights.com, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, do not place an order. Use of this website and its services constitutes acceptance of these Terms.

1. PARTIES AND DEFINITIONS

These Terms of Service (“Terms”) constitute a binding agreement between you, the party placing an order (“Client,” “you,” or “your”), and Compliance Review Solutions, a California business operating the website name HOA Risk Insights (“Company,” “we,” “us,” or “our”).
 
For purposes of these Terms, the following definitions apply:
“Services” means any document review, compliance analysis, or report product offered through HOARiskInsights.com, including Report A (Seller HOA Disclosure Compliance Review), Report B (Reserve Study Review), and Report C (Buyer HOA Compliance & Document Review).
“Report” means the written analysis document delivered to Client upon completion of a Service.
“Documents” means the HOA disclosure package, reserve study, budget, financial statements, and any other materials uploaded by Client or provided on Client’s behalf for review.
“Order” means a completed purchase transaction for one or more Services.

2. DESCRIPTION OF SERVICES

2.1 Report A — Seller HOA Disclosure Compliance Review ($75)
Report A reviews the HOA disclosure package submitted with your order to determine whether the 33 documents required under California Civil Code (Davis-Stirling Act) are present and current. For new construction properties, two additional items (Items 32–33) apply for a total of 35 required items.
Report A produces a checklist identifying each document as: Received, Received but out-of-date or invalid, or Missing. Document contents are not reviewed. Report A is available to both sellers and buyers.

2.2 Report B — Reserve Study Review ($125)
Report B extracts specific financial data from the HOA’s Reserve Study and related documents and performs a defined series of calculations to assess reserve fund health and financial risk. Report B includes:
Reserve fund fully funded percentage and risk rating
Estimated and actual deficiency per unit (where documents permit)
10-year projected reserve balance
Special assessment analysis
10-year HOA dues outlook projection
SB326/Exterior Elevated Elements inspection status
Plain-English bottom line summary with questions to ask before the HOA contingency period expires
Report B is available to buyers.

2.3 Report C — Buyer HOA Compliance & Document Review ($450)
Report C is the comprehensive buyer report. It includes the complete 33-item Document Checklist (Report A), the full Reserve Study financial analysis (Report B), and substantive content review of the governing documents, insurance summary, annual budget, and all applicable policy and disclosure documents.
Report C is available to buyers.

2.4 Scope of All Services
All reports are document review services only. We assess whether required documents are present (Reports A and C), extract and calculate defined financial metrics (Reports B and C), and summarize document content (Report C only). We do not provide legal advice, financial advice, real estate advice, or insurance advice. See Section 3.
 
IMPORTANT DISCLAIMER
HOA Risk Insights is a document review and analysis service. The Reports produced by Compliance Review Solutions do not constitute legal advice, financial advice, real estate advice, or insurance advice. No attorney-client relationship, financial advisory relationship, or fiduciary duty is created by your use of these Services or receipt of any Report.
Specifically, our Reports:

Are prepared for informational purposes only and are current only as of the date of the documents reviewed.

Do not guarantee the accuracy, completeness, or currency of any documents provided by the HOA, property management company, or seller.

Do not predict, forecast, or represent any future action by the HOA, its Board of Directors, or any property management company.

Do not opine on the enforceability of any HOA governing document provision.

Do not advise on lending eligibility, FHA/VA approval status, or financing qualification, except where such status is factually stated in the documents reviewed.
 
Clients should consult a licensed California real estate attorney for legal advice, a licensed financial advisor for investment guidance, and a licensed insurance agent regarding coverage questions.

4. ORDER PLACEMENT AND PAYMENT

4.1  Order Submission
Orders are placed through the HOARiskInsights.com website. By submitting an order, you represent that: (a) you are authorized to submit the Documents provided; (b) all information you provide is accurate and complete; and (c) you are at least 18 years of age.
 
4.2  Payment
Payment is due in full at the time of order placement. We accept payment via the methods displayed on the checkout page. All prices are stated in U.S. dollars. Applicable sales taxes, if any, will be added at checkout.
 
4.3  Report A and/or Report B Upgrade Credit
Clients who have previously ordered Report B for the same property may apply a credit toward a Report C order. The upgrade credit is equal to the Report B fee paid, subject to verification of the prior order. Credits are non-transferable and apply only to the same property address.

5. DOCUMENT SUBMISSION AND CUSTOMER RESPONSIBILITIIES

5.1  Client Obligations

It is your responsibility to upload complete, legible, and accurate HOA document packages. The quality and completeness of our Reports depend entirely on the documents you provide. We are not responsible for incomplete or inaccurate analyses resulting from incomplete or illegible document submissions.

5.2  Document Completeness

If our review determines that required documents are missing from the submitted package, we will notify you per the process described in our Report C Two-Tier Supplemental Review protocol (for Report C orders) or by separate communication (for Reports A and B). Missing documents may delay report delivery.

5.3  Authorized Use of Documents

By submitting Documents to HOA Risk Insights, you represent that you have the legal right to provide those Documents for review and that your submission does not violate any confidentiality obligation, contractual restriction, or applicable law.

6. DELIVERY AND TURNAROUND

We target report delivery within the timeframe stated on the product page at the time of order. Turnaround times are estimates and are not guaranteed. Delays may result from incomplete document submissions, high order volume, or circumstances outside our control. We will notify you if a material delay is anticipated.

Reports are delivered electronically to the email address provided at checkout. You are responsible for providing a valid, accessible email address and for retrieving your Report within a reasonable time of delivery.

7. REFUND POLICY

7.1  General Policy

All sales are final once report production has commenced. “Commenced” means we have begun reviewing the submitted Documents, which typically occurs within four hours on the business day of order placement and document receipt.

7.2  Pre-Commencement Cancellations

If you request cancellation before report production has commenced, we will issue a full refund. Contact us immediately at in**@*************ts.com or (925) 693-0679 to request cancellation.

7.3  Report C Resubmissions

If a Report C order triggers a Tier 1 Hard Stop due to missing governing or financial documents, no deliverable has been produced and no charge is assessed until the complete document package is resubmitted. The original payment is held and applied to the resubmission.

7.4  Disputes

If you believe a Report contains a material error in document identification or calculation, contact us within 10 calendar days of delivery. We will review the issue and, if a material error is confirmed, provide a corrected Report at no additional charge. Refunds are not available on the basis of disagreement with findings or risk assessments.

8. INTELLECTUAL PROPERTY

8.1 Ownership of Reports
All Reports produced by Compliance Review Solutions are the proprietary work product of Compliance Review Solutions and are protected by U.S. copyright law. Compliance Review Solutions retains all ownership rights in the Reports, including the format, analysis structure, methodology, templates, and all written content.

8.2 License to Client
Upon full payment of your order, Compliance Review Solutions grants you a limited, non-exclusive, non-transferable license to use the Report for your personal, non-commercial purposes in connection with the real estate transaction for which the Report was ordered. This license permits you to share the Report with your real estate agent, lender, or legal counsel in connection with that transaction.

8.3 Prohibited Uses
You may not reproduce, distribute, republish, sell, sublicense, or otherwise make the Report available to any third party for commercial purposes. You may not modify, adapt, or create derivative works from any Report. You may not represent any Report as your own work or remove any copyright or proprietary notices.

8.4 Underlying Documents
The HOA documents you submit for review remain the property of their respective owners (the HOA, property management company, or other originating parties). Compliance Review Solutions claims no ownership interest in any documents submitted by you or on your behalf.

8.5 Feedback
If you provide feedback, suggestions, or comments regarding our Services, you grant Compliance Review Solutions a perpetual, irrevocable, royalty-free license to use that feedback for any business purpose, including improving our Services, without any obligation to you.

9. LIMITATION OF LIABILITY

LIMITATION TO LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COMPLIANCE REVIEW SOLUTIONS’ TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES, REGARDLESS OF THE FORM OF ACTION, SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.

Compliance Review Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: lost profits, loss of a real estate transaction, costs of alternative housing, special assessment obligations incurred after closing, or any HOA action taken after the date of the Documents reviewed.
 
Our liability is strictly limited to correction of material errors in the Reports we deliver. We are not responsible for errors or omissions in the underlying Documents provided to us by the HOA, property management company, or seller.

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Compliance Review Solutions, its principals, employees, and agents from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Services; (b) your submission of Documents you were not authorized to provide; (c) your misuse or unauthorized redistribution of any Report; or (d) your violation of these Terms.

11. PRIVACY AND DATA

11.1  Information We Collect

We collect the personal and transaction information you provide when placing an order, including name, email address, property address, and uploaded documents. We use this information solely to process and deliver your order and to communicate with you about your order.

11.2  Document Handling

Documents submitted for review are stored securely and used only for the purpose of producing your Report. We do not sell, rent, or share your Documents or personal information with third parties, except as required by law or as necessary to deliver the Service (e.g., secure cloud storage providers operating under confidentiality obligations).

11.3  Document Retention

Order records and submitted documents are retained for a reasonable period consistent with our business records obligations and applicable law. You may request deletion of your data by contacting in**@*************ts.com, subject to any legal retention requirements.

12. MODIFICATIONS TO THESE TERMS

We reserve the right to modify these Terms at any time. Updated Terms will be posted on HOARiskInsights.com with a revised effective date. Your continued use of the Services following any modification constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically. Material changes will be communicated via website notice.

13. DISPUTE RESOLUTION AND GOVERNING LAW

13.1  Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions.
 
13.2  Informal Resolution
Before initiating any formal dispute process, you agree to contact us at in**@*************ts.com to describe the issue and allow us a reasonable opportunity (not less than 30 days) to resolve it informally.
 
13.3  Venue
Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Contra Costa County, California. You consent to personal jurisdiction and venue in those courts.

14. MISCELLANEOUS

14.1  Entire Agreement
These Terms, together with our Privacy Policy, Text Messaging & MMS Policy, and any order confirmation, constitute the entire agreement between you and Compliance Review Solutions regarding the Services and supersede all prior or contemporaneous understandings.
 
14.2  Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
 
14.3  No Waiver
Failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
 
14.4  Assignment
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
 
14.5  Force Majeure
We shall not be liable for any delay or failure to perform our obligations resulting from circumstances beyond our reasonable control, including natural disasters, government action, internet outages, or platform failures.
By placing an order with Compliance Review Solutions through HOA Risk Insights,
you confirm that you have read and agree to these Terms of Service.
